Who Needs a Conservatorship?

If you are the parent, grandparent or guardian of a special needs child approaching adulthood it is crucial for you to start planning now for how their important life decisions will be made once they turn 18.  After an individual reaches age 18 they are presumed to have the right to make their own decisions regarding their own life choices.  In order for you to continue assisting them in making these decisions, you may need a conservatorship.  A conservatorship will allow you to have access to medical and other personal records, and to have the authority to advocate for your special needs loved one when needed.

What Type of Conservatorship do I Need?

There are different types of conservatorships available; general conservatorships of the person/estate, LPS conservatorships, and limited conservatorships.  Limited conservatorships are specifically designed for adults with developmental disabilities.  We can assist you in determining the right conservatorship for your particular situation, and assist you in walking through the entire process, all at a reasonable hourly rate.

What is a Special Needs Trust?

As the parent of a special needs child of any age it is crucial to plan for their future care in case of your death or incapacity for any reason.  A special needs trust is a specific type of trust designed to preserve a disabled person’s eligibility for government benefits.  These public benefits may include means-tested programs where eligibility is based on financial need, such as Medicaid or Supplemental Security Income (“SSI”), or insurance programs where eligibility is based on criteria other than financial need, such as Medicare or Social Security Disability Income.
